About these terms

COOKIT is operated by Cookit Technologies Pty Ltd, ABN 70 702 762 187, ACN 702 762 187, of 520/7 Potter Street, Waterloo NSW 2017, Australia ("COOKIT", "we", "us" or "our"). Contact: [email protected]. Effective date: 29 September 2026. Last updated: 29 September 2026.
These Terms govern your use of the COOKIT mobile application, website and related services. By creating an account or using COOKIT, you agree to these Terms. If you do not agree, do not create an account or use COOKIT.

1. Eligibility

You must be at least 18 years old and legally capable of entering into these Terms. You must provide accurate account information and use COOKIT only in accordance with applicable law. You may create household profiles only where you have authority to provide and manage the relevant information.

2. Your account

You are responsible for maintaining the security of your account, using accurate and current information, activity undertaken through your account, notifying us promptly of suspected unauthorised access, and not creating additional accounts to avoid restrictions or Fresh Points limits.
You must not sell, transfer or share access to your account.

3. What COOKIT provides

COOKIT provides tools that may help users record and manage fridge and pantry inventory, receive recipe and meal suggestions, monitor food dates, manage household food information, locate retailers and community food listings, share fridge information with authorised people, exchange eligible food through the marketplace, and participate in the Fresh Points system.
Features may change as COOKIT develops. We will provide reasonable notice of material changes where practical.

4. Inventory, recipes and recommendations

Inventory quantities, freshness estimates, expiry reminders, recipe matches, substitutions, nutritional information and recommendations may be incomplete or inaccurate.
You remain responsible for checking the actual food item, packaging and food labels, use-by and best-before dates, ingredients and allergens, storage conditions, cooking instructions, and suitability for your household.
COOKIT does not provide medical, dietary or allergy-safety advice. Seek qualified professional advice for medical or dietary concerns. Do not rely solely on COOKIT to avoid an allergen or determine whether food is safe to consume.

5. Privacy and personalisation

Our Privacy Policy and Collection Notice explain how we handle personal information.
Allergy information, intolerances and health-related goals are optional. Where required, we will seek separate express consent before collecting or using this information. You can review or withdraw optional consent in Settings. Withdrawal may limit personalised functionality.
Location permissions are optional unless a specific feature requires location. We will explain why location is requested before asking for device permission.

6. User content

You may upload information such as photographs, listings, fridge decorations, notes, messages, ratings and profile content. You retain ownership of your content.
You grant COOKIT a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, moderate and technically adapt that content only as reasonably necessary to operate, protect and improve COOKIT. You must have the right to upload your content.
You must not upload content that is unlawful, fraudulent or misleading, threatening, abusive or discriminatory, sexually explicit or exploitative, dangerous, defamatory, invasive of another person's privacy, infringing intellectual property, spam or unauthorised advertising, designed to manipulate ratings or Fresh Points, or related to prohibited or unsafe food.
We may investigate, restrict or remove content that may breach these Terms or create safety, legal or operational risks. Users can report content and accounts and block other users. We will provide reasonable complaint and appeal channels.

7. The community marketplace

The marketplace allows members to list and exchange eligible food directly with other members.
Unless expressly stated otherwise: the listing member is the supplier of the food; the claiming member receives the food directly from the listing member; COOKIT provides the technology marketplace and administers Fresh Points; COOKIT does not own, possess, prepare, package, inspect or deliver the food; and COOKIT is not a party to the physical handover.
COOKIT may establish listing rules, moderate listings, reserve or reverse Fresh Points, handle disputes and restrict accounts. Nothing in these Terms excludes rights or obligations that cannot lawfully be excluded.

8. Eligible food

A private member may list only food permitted by COOKIT's current listing rules. This may include commercially packaged food that remains manufacturer-sealed and unopened, food still within permitted date requirements, whole uncut and unprocessed fruit, vegetables and herbs, and eligible home-grown produce that has not been cut, cooked, served or processed.
A closed container does not make home-prepared food manufacturer-sealed. Home-cooked or home-prepared food may be listed only through an approved verified-provider pathway where COOKIT makes that pathway available.
You must not list food past its use-by date, opened or partly consumed food, food already served to another person, recalled food, food you know or reasonably suspect is contaminated or unsafe, misleadingly described food, food prohibited by COOKIT's listing rules, home-prepared food without required verification, or regulated products COOKIT does not permit. Additional category-specific rules may apply.

9. Lister responsibilities

By publishing a listing, you confirm that you have the right to supply the food; the listing and photographs are accurate; required date, ingredient, allergen and storage information is accurate to the best of your knowledge; sealed food remains manufacturer-sealed; fresh produce meets the stated condition; the food has been stored as described; you will notify COOKIT if the food becomes unavailable, damaged, recalled or unsafe; and you will comply with applicable food-business obligations if acting commercially or regularly.
Do not claim food is certified organic unless you can substantiate that claim.

10. Claimant responsibilities

Before accepting food, you should personally check the food and packaging, date information, ingredients and allergens, visible condition, whether storage requirements appear to have been maintained, and whether the food remains suitable for you and your household.
You may decline a handover and report the listing if it materially differs from its description or appears unsafe.

11. Private and commercial listers

COOKIT may distinguish between private occasional members and verified food providers or businesses.
Commercial, regular or business listers remain responsible for their own registrations and licences, council and food-authority requirements, tax and GST obligations, labelling and allergen requirements, consumer-law obligations, and food-safety duties.
COOKIT does not provide individual legal, food-safety or tax advice.

12. Fresh Points

Fresh Points are closed-loop COOKIT food-exchange credits.
Fresh Points are not money; cannot be purchased, sold or cashed out; cannot be exchanged for money; cannot be transferred independently between users; cannot be used outside eligible COOKIT food exchanges; do not earn interest; are not an investment; do not represent ownership in COOKIT; and have no displayed or guaranteed exchange rate to Australian dollars.
Fresh Points may be reserved when a claim is made and transferred after the exchange is confirmed. A cancelled, failed or disputed exchange may result in points being released, held or reversed.
COOKIT may impose user balance, transaction and system-wide limits. An exchange may be prevented where either party lacks sufficient balance or receiving capacity.
Fresh Points currently have no expiry unless clearly disclosed otherwise. Any future expiry arrangement will be prominently disclosed before it applies. You can check your available balance, reserved balance and transaction history without charge.
If you believe a transaction was mistaken or unauthorised, report it promptly through the in-app support process. We will investigate and explain the outcome. COOKIT may correct ledger errors and reverse fraudulent or duplicated transactions. We will not remove valid Fresh Points arbitrarily.
If COOKIT materially changes or closes the Fresh Points program, we will provide reasonable notice and, where practical, an opportunity to use valid points before closure. Fresh Points will not be converted to cash.

13. Suggested Fresh Points ranges

COOKIT may provide a suggested Fresh Points range using factors such as food category, quantity, condition and freshness, remaining shelf life, local availability and recent COOKIT exchanges.
A suggested range is not a cash valuation, a guaranteed market price, a professional valuation or an external exchange rate. The lister remains responsible for choosing the final permitted Fresh Points amount.
Sponsored placement or fees affecting ranking will be clearly identified.

14. Collection and disputes

Members are responsible for arranging lawful and safe collection. Exact home addresses should not be displayed publicly. Points may remain reserved until the required collection confirmation occurs.
Users must not falsely confirm a collection, manipulate a transaction, arrange fake exchanges or collude to create Fresh Points activity.
Available dispute reasons may include non-collection, material misdescription, opened or damaged packaging, expiry issues, allergen-information concerns, unsafe handling concerns, recalled food, abusive conduct and suspected fraud.
COOKIT may review available evidence and make a reasonable decision about point reservation, release or reversal. Users may request review through the available appeal process.

15. Fees and advertising

COOKIT will disclose applicable fees before they are incurred. COOKIT will identify sponsored or paid placement, and will not represent sponsored ranking as an independent food-safety or quality assessment.
COOKIT Premium · Monthly is an auto-renewing subscription. The purchase screen will show the recurring price in your local currency, the monthly billing period, the Premium benefits then available, whether any trial or introductory offer applies, when payment starts, and how to cancel. No trial applies unless the purchase screen expressly offers one. Your subscription renews each month until you cancel it through the store or web billing account through which you bought it. Cancellation normally stops the next renewal; access ordinarily continues until the end of the paid period. Apple, Google or the applicable web payment provider processes the payment and administers store refunds, subject always to rights and remedies that cannot lawfully be excluded.
If Official Fridge publishing becomes available, its confirmation screen will separately disclose the Base network gas estimate, any COOKIT service fee and the maximum total amount before you approve a wallet transaction. Network gas is paid in ETH and can vary. COOKIT does not promise that a published fridge, token or related record has or will gain monetary value, is transferable for profit, earns returns or is an investment. COOKIT does not custody your wallet or crypto-assets and will never ask for a private key or recovery phrase.
Third-party advertisers and retailers are responsible for their own products, offers and representations, subject to applicable law.

16. Safety and conduct

You must act respectfully and safely when communicating or meeting other users.
You must not harass, threaten or discriminate; impersonate another person; reveal another person's private address or information; misuse messaging; manipulate reviews; create fake listings or claims; engage in unsafe collection behaviour; or use COOKIT for unlawful activity.
Use public pickup locations where appropriate. Contact emergency services where there is an immediate threat to safety.

17. Third-party services

COOKIT may link to retailers, maps, recipe sources, image providers, payment providers or other third-party services. Third-party services have their own terms and privacy practices. COOKIT is not responsible for third-party services except to the extent required by law.

18. Intellectual property

COOKIT and its licensors own the application, software, branding and COOKIT-created content. You may use COOKIT only for personal or authorised business use through the functionality provided. You must not copy, scrape, reverse engineer, interfere with or commercially exploit COOKIT except where applicable law permits it.

19. Suspension and termination

We may warn, restrict or suspend an account where reasonably necessary to investigate suspected fraud, protect users, respond to safety concerns, comply with law, enforce these Terms, prevent manipulation of Fresh Points, or address repeated prohibited listings. Where appropriate, we will explain the reason and provide an appeal opportunity. Serious or urgent risks may require immediate action.
You may stop using COOKIT or request account deletion at any time. Account deletion does not require COOKIT to delete information that must reasonably be retained for legal compliance, fraud prevention, safety, disputes or transaction integrity. Our Privacy Policy explains retention and deletion practices.
Any Fresh Points remaining when you voluntarily delete your account cannot be redeemed for cash.

20. Consumer rights

Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Where COOKIT supplies services covered by a non-excludable guarantee, your remedies remain available under applicable law.

21. Responsibility and liability

Each food lister is responsible for the food they supply and the accuracy of their listing. COOKIT remains responsible for its own services, representations, algorithms, advertising, fees and dispute processes to the extent required by law.
To the extent permitted by law, COOKIT is not responsible for loss caused solely by another member's unlawful conduct, information concealed from COOKIT, failure to follow clear safety instructions, unauthorised use of an account before COOKIT is notified, third-party services outside COOKIT's reasonable control, or events outside COOKIT's reasonable control.
This section does not limit liability that cannot legally be limited, including liability arising from COOKIT's own fraud, wilful misconduct or negligence where it cannot lawfully be excluded.

22. Changes to these Terms

We may change these Terms where reasonably necessary for legal, safety, security, operational or product reasons. We will provide reasonable notice of material changes. Material changes will not operate retrospectively unless required by law. Where renewed acceptance is required, we will ask you to accept the updated version before continuing to use the affected feature.

23. Complaints

Contact [email protected]. Fresh Points complaints can be made through the in-app support process. Privacy complaints: [email protected].
Safety reports should be made through the in-app reporting tools where available. We will acknowledge and handle complaints within reasonable timeframes and provide available escalation or appeal information.

24. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts and tribunals of New South Wales have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable consumer law.
